In the state of Wisconsin, can I be disciplined at my job, for not cleaning up human waste in a bathroom?

I did an interview today for a job promotion. I did great in the interview, however, mere hours after, I was asked to clean the women's bathroom as someone had aimed at the wall rather than the bowl. I refused to do it. I'm almost certain that, because of this, I will be turned down for the promotion. Up until that point I have had nearly perfect attendance (everyone calls in from time to time). I've been an extremely hard working team leader, I know the ins and outs of their computer system, I'm one of the best choices for that position. Can I get disciplined, or even worse, turned down from the promotion because I refused to clean the bathroom? Are there any laws that would support my unwillingness to not clean up after someone who makes such a disgusting mess?

The law only requires your employer to provide you with proper safety equipment when doing this type of job. If they refused to supply you with gloves, you might have a legal case.





However, somebody needs to clean up the mess, and since there's no way to figure out who left the mess, the task was assigned to you. Your unwillingness to perform the task you were asked to do can be held against you. Whether or not it will affect your chances of getting the promotion are up to the management. Perhaps they will overlook this situation and realize you are the best candidate for the job. However they might look at it as you are not willing to do whatever needs to be done, so therefore you are not the right candidate.





Regardless, there are no laws that prevent them from asking you to clean up the mess and there are no laws that prohibit them from holding it against you. The task needed to be done and you were unwilling to do it, it doesn't matter what the task was.
Reply:Is cleaning the bathrooms part of your normal job duties and did the employer provide suitable cleaning tools and protective gear?
Reply:some one has to do the job. If you are hourly then yes it could be bad for you.
Reply:you should of went in there dropped your pants and took a dump in the sink....then walked out!
Reply:Well you could be written up for insubordination. I was going to say it depends on what your job is. But since you work at a retail store, my first question would be are employees usually required to make sure bathrooms are cleaned? And if not, who usually handles this task? Is there a company contracted to do so? Is there a porter that the store has that usually handles this job function?





Another thing you should do is check what your job duties are? Employers have a funny way of attaching that "Other job duties as necessary" to tasks that are not directly related to what our duties are and often use that as an excuse to assign those "other job duties" to us.





Now it also depends on who asked you to clean the mess. If it was not a store manager, then I would go to the store manager (or at least before I said no) and voiced my conerns with having to clean a restroom. So that also plays a part, how you declined to clean the restroom.





So there are a lot factors that play into it.
